How Mobeus Processes Data on Behalf of Businesses Using Our Embedded Conversational AI

1. About This Notice

This Mobeus AI Services Privacy Notice (“Notice”) explains how Mobeus Industries, Inc. (“Mobeus,” “we,” “our,” or “us”) processes personal data as a data processor on behalf of businesses that embed Mobeus’s conversational AI experience (the “Service”) on their own website or application (each, a “Customer”).

This Notice is not a general Mobeus privacy policy and does not apply to mobeus.com or to any other Mobeus product. For Mobeus’s general site privacy practices, see our Privacy Policy at mobeus.com/privacy. For information about your rights, or about any information collected directly by the operator of the website or application where you encountered the Service (for example, through its own contact or scheduling forms), see that operator’s own privacy policy.

2. Our Role: Data Processor

For each integration, the Customer that has embedded the Service is the data controller and determines the purposes and means of processing. Mobeus acts solely as a data processor, processing personal data only on that Customer’s documented instructions, as set out in the Data Processing Agreement between Mobeus and the Customer (each, a “DPA”).

3. What Data We Process

On the applicable Customer’s instructions, Mobeus processes the following categories of data in connection with the Service:

  • Conversational data. Text you type and, if you choose to enable voice, your spoken audio. Voice input is transcribed in order to generate a response.
  • Session and technical data. Limited technical information necessary to maintain and operate your conversation session (for example, a session identifier and timestamps).

Mobeus does not receive or process contact details you may separately choose to submit through forms or other tools operated directly by the website or application where you encountered the Service (for example, to request contact from a sales representative). That information is collected and controlled directly by the operator of that site and is governed by their own privacy policy, not this Notice.

4. How We Use This Data

  • To generate real-time responses to your questions and requests.
  • To analyze interaction patterns and conversation themes in order to improve the assistant’s accuracy. Transcripts used for this analysis are not linked to your identity, IP address, or any other identifier that could be used to identify you.

Mobeus does not use this data for advertising and does not sell personal information.

5. Sub-processors and Third-Party AI Providers

Mobeus uses third-party AI providers to power the Service, including providers of large language model, speech-to-text, and text-to-speech technology. These providers process data solely to generate responses within your conversation session.

  • Our large language model provider processes conversational data under enterprise terms that prohibit use of submitted data to train its models.

A current list of sub-processors is available to Customers upon request and is maintained as part of the applicable DPA.

6. Security Measures

Mobeus implements administrative, technical, and organizational measures designed to protect personal data processed under this Notice against unauthorized access, disclosure, alteration, or loss, consistent with the security terms set out in the applicable DPA. Mobeus maintains an active program to review and enhance these measures over time. No system can be guaranteed to be completely secure.

7. Security Incident Notification

If Mobeus becomes aware of a security incident affecting personal data processed under this Notice, Mobeus will notify the affected Customer without undue delay and in accordance with the timeframes and procedures set out in the applicable DPA.

8. Data Retention

Conversational data is retained only for as long as necessary to provide the Service and to support the accuracy-improvement purpose described in Section 4, consistent with the retention terms set out in the applicable DPA.

9. International Data Transfers

Mobeus is based in the United States. Conversational data is processed and stored on servers located in the United States. Where required, such transfers are made subject to appropriate safeguards as set out in the applicable DPA between Mobeus and the relevant Customer.

10. Session Handling

To help protect your privacy, sessions end automatically after a period of inactivity.

11. Automated Decision-Making

Mobeus does not use personal data processed under this Notice to make decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you.

12. Your Rights

Because the Customer that embedded the Service is the data controller for that integration, requests to access, correct, delete, or otherwise exercise your data protection rights should be directed to that Customer — typically the operator of the website or application where you interacted with the Service. Mobeus will support the applicable Customer in responding to such requests as required under the DPA.
